Cookies refer to small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
Company (referred to as either "the Company", "We", "Us" or "Our" in this Privacy Policy) refers to KK Brands LLC, a Delaware limited liability company, and its Affiliates. For the purpose of the GDPR and DPA 2018, the Company is the Data Controller.
Consumer, for the purpose of the CCPA and CPRA, means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the State for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the State who is outside the State for a temporary or transitory purpose.
Contractor, for the purpose of the CPRA, means a person to whom the business makes available a consumer's personal information for a business purpose pursuant to a written contract, provided that the contract prohibits the person from retaining, using, or disclosing the personal information for any purpose other than for the specific purpose of performing the services specified in the contract, including retaining, using, or disclosing the personal information for a commercial purpose other than providing the services specified in the contract, or as otherwise permitted by the CCPA.
Content refers to content such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available by You, regardless of the form of that content.
Country refers to the United States of America.
Data Controller, for the purposes of the GDPR and DPA 2018, refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Information.
Device means any device that can access the Service, including, but not limited to, a computer, a cellphone, or digital tablet.
DPA 2018 refers to the Data Protection Act of 2018, as the same may be amended from time to time.
Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.
GDPR refers to the General Data Protection Regulation (EU) 2016/679, as the same may be amended from time to time.
Global Privacy Control (GPC) is a browser-based technical specification that enables users to signal their opt-out preferences regarding the sale or sharing of personal information and use for targeted advertising, recognized as a valid opt-out mechanism under California and other state privacy laws.
Personal Data or Personal Information is any information that relates to an identified or identifiable individual. For the purposes of GDPR and DPA 2018, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity. For the purposes of the CCPA and CPRA, Personal Information means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.
Sale, for the purpose of the CCPA and CPRA, means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer's personal information to another business or a third party for monetary or other valuable consideration.
Sensitive Personal Information (SPI), for the purpose of the CPRA and other state privacy laws, means: (1) personal information that reveals a consumer's social security, driver's license, state identification card, or passport number; (2) a consumer's account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (3) a consumer's precise geolocation; (4) a consumer's racial or ethnic origin, religious or philosophical beliefs, or union membership; (5) the contents of a consumer's mail, email, and text messages unless the business is the intended recipient of the communication; (6) a consumer's genetic data; (7) the processing of biometric information for the purpose of uniquely identifying a consumer; (8) personal information collected and analyzed concerning a consumer's health; and (9) personal information collected and analyzed concerning a consumer's sex life or sexual orientation. Sensitive Personal Information also includes "sensitive data" as defined under Virginia, Colorado, Connecticut, and other state comprehensive privacy laws.
Service refers to any access of, links, or content provided on, the Website and the Website itself.
Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. For the purpose of the GDPR, Service Providers are considered Data Processors. For the purpose of the CPRA, Service Provider means a person that processes personal information on behalf of a business and that receives from or on behalf of the business a consumer's personal information for a business purpose pursuant to a written contract, provided that the contract prohibits the person from retaining, using, or disclosing the personal information for any purpose other than for the specific purpose of performing the services specified in the contract, including retaining, using, or disclosing the personal information for a commercial purpose other than providing the services specified in the contract, or as otherwise permitted by the CCPA.
Share or Sharing, for the purpose of the CPRA, means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's personal information by the business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration, including transactions between a business and a third party for cross-context behavioral advertising for the benefit of a business in which no money is exchanged.
Terms and Conditions (also referred to as "Terms") mean the Company's Terms and Conditions that form the entire agreement, along with any policies incorporated by reference therein, including this Privacy Policy, between You and the Company regarding the use of the Service, as may be updated at any time in the Company's sole discretion, the current version of which is available here: https://khalifakush.com/pages/terms-and-conditions.
Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Legal Basis for Processing Personal Information under GDPR
We may process Personal Information under the following conditions:
Consent: You have given Your consent for processing Personal Information for one or more specific purposes.
Performance of a contract: Provision of Personal Information is necessary for the performance of an agreement with You and/or for any pre-contractual obligations thereof.

You may exercise Your rights of access, rectification, erasure, restriction, data portability, objection, cancellation and opposition by contacting Us using the methods provided in Section XXIII (Contact Us). Please note that we may ask You to verify Your identity before responding to such requests. If You make a request, We will try our best to respond to You as soon as possible and in any event within one month of receipt of Your request, with the possibility to extend by two further months where necessary, taking into account the complexity and number of requests.

X. DPA 2018 PRIVACY (APPLIES TO UNITED KINGDOM RESIDENTS ONLY)
This privacy notice section for United Kingdom residents supplements the information contained in Our Privacy Policy and it applies solely to all visitors, users, and others who reside in the United Kingdom.
a. Applicability under DPA 2018

c. Exercising of Your DPA 2018 Data Protection Rights
You may exercise Your rights of access, rectification, erasure, restriction, data portability, objection, cancellation and opposition by contacting Us using the methods provided in Section XXIII (Contact Us). Please note that we may ask You to verify Your identity before responding to such requests. If You make a request, We will try our best to respond to You as soon as possible and in any event within one month of receipt of Your request, with the possibility to extend by two further months where necessary.
You have the right to complain to the Information Commissioner, who is an independent regulator. Any complaint to the Information Commissioner is without prejudice to your right to seek redress through the courts about Our collection and use of Your Personal Information. XI. CCPA AND CPRA PRIVACY
This privacy notice section for California residents supplements the information contained in Our Privacy Policy and it applies solely to all visitors, users, and others who reside in the State of California.

Sale of Personal Information
As defined in the CCPA and CPRA, "sell" and "sale" mean selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's personal information by the business to a third party for monetary or other valuable consideration. This means that We may have received some kind of benefit in return for sharing personal information, but not necessarily a monetary benefit.
We do not sell Personal Information as defined under the CCPA and CPRA. We have not sold Personal Information in the preceding twelve (12) months.

XVII. CHILDREN'S PRIVACY
A. Minors Under 13 — COPPA Compliance
Our Service is not intended for children under the age of 13. We do not knowingly collect Personal Information from children under 13 without verifiable parental consent as required by the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq.
If We become aware that We have collected Personal Information from a child under 13 without verification of parental consent, We will take steps to delete that information as quickly as possible. Sale and Sharing of Personal Information of Minors Under 16 Years of Age
We do not knowingly collect personal information from minors under the age of 16 through Our Service, although certain third party websites that we link to may do so. These third-party websites have their own terms of use and privacy policies and We encourage parents and legal guardians to monitor their children's Internet usage and instruct their children to never provide information on other websites without their permission.
Under California law, We do not sell or share the personal information of Consumers We actually know are less than 16 years of age without affirmative authorization. For consumers between 13 and 16 years of age, We require opt-in consent from the consumer. For consumers under 13 years of age, We require opt-in consent from the consumer's parent or guardian.
If You have reason to believe that a child under the age of 16 has provided Us with personal information, please contact Us immediately with sufficient detail to enable Us to delete that information.
California — Removal Rights for Minors
California Business and Professions Code Section 22581 allows California residents under the age of 18 who are registered users of online sites, services, or applications to request and obtain removal of content or information they have publicly posted.
To request removal of such data, please contact Us using the contact information provided in Section XXIII and include the email address associated with Your account and a statement that You reside in California. We will make reasonable good faith efforts to remove or anonymize such information from public view. Be aware that Your request does not guarantee complete or comprehensive removal of content or information posted online and that the law may not permit or require removal in certain circumstances, including if:
- Federal or state law requires Us or a third party to maintain the
content or information
- The content or information was not posted by You
- We anonymize the content or information so that You cannot be
individually identified
- You do not follow the required request instructions

You have the right to request the deletion of Your Personal Information, subject to certain exceptions. Once We receive and confirm Your verifiable consumer request, We will delete (and direct Our Service Providers and Contractors to delete) Your personal information from our records, unless an exception applies. We may deny Your deletion request if retaining the information is necessary for Us or Our Service Providers and Contractors to:
Complete the transaction for which We collected the personal information, provide a good or service that You requested, take actions reasonably anticipated within the context of our ongoing business relationship with You, or otherwise perform our contract with You.

You have the right to direct Us to limit Our use of Your Sensitive Personal Information to uses necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services, and for the additional specified purposes permitted under CPRA (see Section XI-B above).

G. The Right to Opt Out of Automated Decision-Making
You have the right to opt out of automated decision-making technology, including profiling, used to make decisions that produce legal or similarly significant effects concerning You.
We do not currently use automated decision-making technology that produces legal or similarly significant effects concerning You.
H. The Right to Non-Discrimination
You have the right not to be discriminated against for exercising any of Your consumer rights, including by:
Denying goods or services to You
Charging different prices or rates for goods or services, including the use of discounts or other benefits, or imposing penalties
Providing a different level or quality of goods or services to You
Suggesting that You will receive a different price or rate for goods or services or a different level or quality of goods or services.
However, We may charge You different prices or rates, or provide a different level or quality of goods or services, if that difference is reasonably related to the value provided to You by Your Personal Information, or offer You financial incentives for the collection, sale, or deletion of Your Personal Information, provided such incentive is not unjust, unreasonable, coercive, or usurious, and is made available in compliance with applicable transparency, informed consent, and opt-in requirements (see Section XXI-A below).

XIX. EXERCISING YOUR CCPA AND CPRA DATA PROTECTION RIGHTS

Only You, or a person or business entity registered with the California Secretary of State that You authorize to act on Your behalf, may make a verifiable consumer request related to Your personal information. Your request to Us must:
Provide sufficient information that allows Us to reasonably verify You are the person about whom We collected personal information or an authorized representative.
Describe Your request with sufficient detail that allows Us to properly understand, evaluate, and respond to it.
We cannot respond to Your request or provide You with the required information if We cannot:
Verify Your identity or authority to make the request; and
Confirm that the personal information relates to You.
We will use Personal Information provided in a verifiable consumer request only to verify the requestor's identity or authority to make the request. You may only make a verifiable consumer request for access or data portability twice within a 12-month period.
We will acknowledge receipt of Your request within 10 days and disclose and deliver the required information free of charge within 45 days of receiving Your verifiable consumer request. The time period to provide the required information may be extended once by an additional 45 days when reasonably necessary and with prior notice. If We require additional time, We will inform You of the reason and extension period in writing.
Any disclosures We provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response We provide will also explain the reasons We cannot comply with a request, if applicable.
For data portability requests, We will select a format to provide Your personal information that is readily useable and should allow You to transmit the information from one entity to another entity without hindrance. We will provide the information in a portable and, to the extent technically feasible, readily usable format that allows You to transmit the information to another entity without hindrance.
We do not charge a fee to process or respond to Your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If We determine that the request warrants a fee, We will tell You why We made that decision and provide You with a cost estimate before completing Your request.
XX. STATE PRIVACY RIGHTS (MULTI-STATE RESIDENTS)
If You are a resident of Virginia, Colorado, Connecticut, Utah, Montana, Oregon, Texas, Delaware, Iowa, Indiana, Tennessee, Nebraska, Kentucky, Maryland, Minnesota, New Hampshire, or New Jersey, You have specific privacy rights under Your state's comprehensive privacy law. This section supplements the information in this Privacy Policy and describes rights that may apply to You.

Residents of the states listed above have the following rights, subject to certain exceptions and limitations under applicable law:
Right to Confirm and Access: The right to confirm whether We are processing Your Personal Information and to access such Personal Information.
Right to Correct: The right to correct inaccuracies in Your Personal Information, taking into account the nature of the Personal Information and the purposes of processing.
Right to Delete: The right to delete Personal Information that You have provided to Us or that We have obtained about You.
Right to Data Portability: The right to obtain a copy of Your Personal Information that You previously provided to Us in a portable and, to the extent technically feasible, readily usable format that allows You to transmit the data to another business, where Our processing is carried out by automated means. You may also have the right to request that We transmit Your Personal Information directly to another business, where technically feasible.
Right to Opt Out: The right to opt out of the processing of Personal Information for purposes of:

We do not collect or process Sensitive Data as defined under applicable state privacy laws.
Right to Non-Discrimination: The right not to receive discriminatory treatment for exercising Your privacy rights.
Right to Appeal: If We decline to take action on Your request, You have the right to appeal Our decision. We will inform You in writing of any action taken or not taken in response to Your appeal, including a written explanation of the reasons for the decisions. If Your appeal is denied, You may contact Your state attorney general to submit a complaint.
Exercising Your Rights
To exercise any of the rights described above, please submit a request by emailing Us at info@khalifakush.com.
We will respond to Your request in accordance with applicable law, generally within 45 days of receipt. If We require more time (up to an additional 45 days), We will inform You of the reason and extension period in writing.
To verify Your identity, We may ask You to provide certain information such as Your name, email address, and other details to match against information We maintain. In some cases, We may request additional information or documentation.
You may designate an authorized agent to make a request on Your behalf by providing written authorization signed by You and the agent. We may require You to verify Your identity directly with Us even if You use an authorized agent.
We do not charge a fee to process or respond to Your request unless it is manifestly unfounded, excessive, or repetitive. If We determine that a fee is warranted, We will inform You and provide a cost estimate before completing Your request.
If We decline to take action on Your request, We will inform You without undue delay and at the latest within the timeframe required by applicable law, along with the reasons for our decision and instructions on how to appeal.
To appeal a decision, please contact Us using the methods above and clearly indicate that You are appealing. We will respond to Your appeal in accordance with applicable law.
XXI. DO NOT SELL OR SHARE MY PERSONAL INFORMATION / UNIVERSAL OPT-OUT MECHANISMS
"Do Not Sell or Share" Right
California residents and residents of other states with comprehensive privacy laws have the right to opt out of the sale and sharing of Personal Information. Please see Section XVIII-E (CCPA and CPRA rights) and Section XX-D (multi-state rights) above for details on how to exercise this right.
We do not sell or share Your Personal Information as defined under California and other state privacy laws. Accordingly, there is no need for You to opt out of such practices.
B. Global Privacy Control (GPC) and Universal Opt-Out Mechanisms
We recognize and honor Global Privacy Control (GPC) and other legally recognized universal opt-out mechanism signals as valid requests to opt out of the sale and sharing of Your Personal Information and use for targeted advertising, as required by California, Colorado, Connecticut, Montana, Oregon, Texas, and other state privacy laws.
GPC is a browser-based setting that allows You to automatically
signal Your privacy preferences to websites You visit. When We detect a
GPC signal from Your browser or device, We will:
- Treat it as a valid request to opt out of the sale of Personal
Information
- Treat it as a valid request to opt out of sharing for cross-context
behavioral advertising (targeted advertising)
- Apply the opt-out to the specific browser or device from which the
signal was sent

Note: GPC signals are browser- or device-specific. If You use multiple browsers or devices, You will need to enable GPC on each one.
C. Financial Incentives
We do not currently offer financial incentive programs that involve the collection, retention, or sale of Personal Information. We do not discriminate against consumers who exercise their privacy rights, including by charging different prices or providing different levels of service.
XXII. "DO NOT TRACK" POLICY AND BROWSER SIGNALS
We do not currently respond to "Do Not Track" (DNT) browser signals or headers. However, We recognize and honor Global Privacy Control (GPC) signals and other legally recognized universal opt-out mechanisms as described in Section XXI-B above.
Some third party websites do keep track of Your browsing activities. If You are visiting such websites, You can set Your preferences in Your web browser to inform websites that You do not want to be tracked. You can enable or disable DNT by visiting the preferences or settings page of Your web browser.

XXIII. YOUR CALIFORNIA PRIVACY RIGHTS (CALIFORNIA'S SHINE THE LIGHT LAW)
